In order to guarantee the same treatment to offending drivers, resident or non-resident in each Member State, the Directive establishes a system for the cross-border exchange of information for eight types of traffic offenses, regardless of their administrative or criminal nature, and that allows access to the State where the offense is committed, to the data of vehicles registered in another Member State. law traffic  The applicable traffic legislation will be that of the Member State where the offense is committed. If the State where the traffic offense occurs decides to initiate a sanctioning proceeding, it shall duly inform the owner, owner of the vehicle or any other person identified as the alleged perpetrator of the aforementioned offense, about the nature of the offense, place, date and time in that was committed, its traffic legislation rules violated, applicable sanction, among others.
