A civil traffic infraction is a non-criminal violation and usually can be disposed of by payment of a civil penalty or election to attend a basic driver improvement course. A court appearance is usually not required unless elected by the defendant. However, there are some traffic violations that result in a mandatory court appearance including, violation involving accident with serious bodily injury or a fatality, violation involving leaving a child in a vehicle unattended, speeding in excess of 30 miles per hour over the speed limit, or littering. Traffic tickets written for certain driver’s license, registration, or insurance violations may be dismissed by the Clerk of Court if you file proof that it was valid at the time the citation was issued.  Civil Traffic Citation is a noncriminal traffic violation that is not punishable by incarceration and for which there is no right to a trial by jury or a right to court-appointed counsel. Most civil traffic infractions do not require a court appearance, but can be disposed by paying a civil penalty, requesting an infraction hearing, or electing to attend a driver improvement course.
