The applicable traffic legislation will be that of the Member State where the offense is committed. If the State where the traffic violation occurs decides to initiate sanctioning proceedings, it will duly inform the owner, owner of the vehicle or any other person identified as the alleged perpetrator of the aforementioned violation, about the nature of the violation, place, date and time in that was committed, its traffic legislation rules violated, applicable sanction, among others.
